1. About these terms

These terms apply to your access and/or use of 2DLogic games, whether on your computer, on a mobile device, on our websites www.sweetclash.com and www.candy-clash.com (the “Website”) or any other website, device or platform (each a “Game” and together the “Games”). They also apply to any other services we may provide in relation to the Games or the Website, such as customer support and community channels (we refer to all our Games and other services collectively as the “Services”). These terms are a legal agreement and contain important information about your rights and obligations.

If you do not agree to these terms, or to any future updated version of them, you must not access or use our Services and must cease all access and use of them.

2DLogic, its subsidiaries and affiliates (“2DLogic”, “Sweet Clash”, “Company”, “our” or “we”) welcome you (“User”, “Player” or “you”) to our online games, available through our websites and as installable mobile applications for iOS and Android.

By connecting to, accessing or playing our Games, and/or creating an account with us, you agree that you have read, understood, accept and agree to be bound by these terms. If you do not agree to these terms, do not connect to, access or use the Games.

You agree that you are at least 13 years old, and that if you are between 13 and 18 years old your legal guardian has reviewed these terms, agrees to them and is happy for you to use our Services.

You can read the latest version of these terms at any time at sweetclash.com/terms-and-conditions.html. We reserve the right to modify, remove, add, amend or otherwise change these terms at any time.

2. Accessing and using our Services

The specific game rules, scoring rules, controls and guidelines for each Game can be found within the Game itself. Those rules form part of these terms and you agree to comply with them.

You are responsible for any internet connection or mobile data charges you incur in accessing our Services. Ask your mobile operator or internet service provider if you are unsure what those charges will be.

There may be times when our Services, or any part of them, are unavailable for technical or maintenance reasons, whether scheduled or unscheduled.

3. Accounts

You may play Sweet Clash as a guest without creating an account. You may also choose to sign in with a Google account so that your progress follows you between devices. If you do, you agree to take reasonable steps to protect access to that account.

We are entitled to assume that anyone signing in to your account is either you or someone doing so with your permission. If you share access to your account, you accept responsibility for the consequences. We are not responsible for any loss you suffer as a result of an unauthorised person accessing your account.

We may delete an account that has not been signed in to for three years. In that event any coins and progress associated with the account are lost. This period matches the one stated in our privacy policy.

If you delete your account, or we delete it in accordance with these terms, you may lose access to all data previously associated with it, including your progress through our Games, the level or score you have reached, and any coins in your balance.

You may delete your account at any time. See Delete your account for how to request it and what happens next. You acknowledge and agree that you have no ownership or other property interest in any account you create.

4. Coins and in-game items

Sweet Clash has no in-app purchases. Coins cannot be bought, and we never take payment details from you. This section describes what coins are, not how to buy them.

Our Games include an in-game currency (“Coins”) and may include in-game items. Coins are awarded through play. You agree that Coins and in-game items have no monetary value and can never be exchanged for real money, real goods or real services, from us or from anyone else. They are not transferable, and you must not transfer or attempt to transfer them to anyone else.

You do not own Coins or in-game items; you hold a limited, personal, revocable licence to use them within the Games. A balance of Coins does not reflect any stored value.

If you play as a guest rather than signing in, your Coins and progress exist only against the anonymous identifier stored in that browser or device. If you clear that storage, lose the device or damage it, we will not be able to restore them, because there is nothing linking that record to you. Signing in with Google is what makes recovery possible.

We reserve the right to control, regulate, change or remove Coins and in-game items, and to limit the amount that may be held in an account, without liability to you. You may only obtain Coins through ordinary play of the Services and not in any other way.

If we introduce paid items in future, we will update these terms before doing so and the purchase will be made through your platform provider, subject to its terms of service.

5. User conduct and content

You must comply with the laws that apply to you where you access our Services from. If any law restricts or prohibits you from using our Services, you must comply with that restriction or stop using them.

You promise that all information you provide to us is and shall remain true, accurate and complete.

You agree that you will not:

  • use our Services to harm anyone, or to cause offence to or harass any person;
  • create more than one account per platform to access our Services;
  • use another person's or entity's email address in order to sign up;
  • use our Services for fraudulent or abusive purposes, including impersonating any person or entity or misrepresenting your affiliation with them;
  • disguise, anonymise or hide your IP address or the source of any content you upload;
  • use our Services for any commercial or business purpose, for the benefit of a third party, or to send unsolicited communications;
  • remove or amend any proprietary notice or ownership information from our Games;
  • interfere with or disrupt our Services, or the servers or networks that provide them;
  • attempt to decompile, reverse engineer, disassemble or hack any of our Services, or to defeat any encryption technology or security measure;
  • harvest, scrape or collect information about other people who use our Services, including any personal data;
  • sell or transfer, or try to sell or transfer, an account or any part of one, including its Coins;
  • disrupt the normal flow of a Game, or act in a way likely to affect other players' ability to compete fairly;
  • disobey any requirement or regulation of a network connected to our Services;
  • use our Services in violation of any applicable law or regulation;
  • cheat, or design or assist in cheating — for example by using automated means or third-party software to play — or otherwise do anything a reasonable person would believe is outside the spirit of fair play; or
  • use our Services in any other way not permitted by these terms.

We do not control content posted by other people and do not guarantee its accuracy, integrity or quality. You may be exposed to content you consider offensive, indecent or objectionable. We will not be liable for any such content or for any loss or harm resulting from it. We have the right to remove content that we decide, in our sole discretion, breaches these terms or may bring us into disrepute, but we do not actively monitor contributed content and make no undertaking to do so. You are solely responsible for your interactions with other users.

6. Playing our Games with other users

Some of our Games let you play against an opponent. You may be able to play against an opponent you choose, or against one that 2DLogic selects for you. Where we select an opponent for you, we may do so at random or using criteria we see fit — for example your past scores, your country, or the level you have reached.

By playing our Games you agree that your display name, avatar, scores, online/offline status and related gameplay details may be shown to other players. Your email address is never shown to other players.

7. Your breach of these terms

Without limiting any other remedy, if we reasonably believe you are in material breach of these terms (including by repeated minor breaches) we reserve the right to take any of the following actions, individually or together, with or without notice:

  • delete, suspend and/or modify your account or parts of it;
  • otherwise suspend and/or terminate your access to our Services;
  • modify and/or remove any Coins or in-game items associated with your account;
  • reset and/or modify any game progression, benefits or privileges associated with your account, such as a level or score you have reached.

You agree to compensate us, according to law, for all losses, harm, claims and expenses arising from any breach of these terms by you.

8. Availability of the Services

The Games' availability and functionality depend on various factors, including software, hardware and the Company's service providers and contractors. 2DLogic does not warrant or guarantee that the Games will operate at all times without disruption or interruption, that they will be immune from unauthorised access, or that they will be error-free.

YOUR USE OF THE GAMES IS ENTIRELY AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR USE OF THE GAMES IN THE JURISDICTION WHERE YOU RESIDE IS PERMITTED UNDER ALL LOCAL LAWS AND REGULATIONS.

9. Intellectual property

You acknowledge that all copyright, trade marks and other intellectual property rights in and relating to our Services are owned by or licensed to us.

YOU ACKNOWLEDGE AND AGREE THAT, OTHER THAN THE LICENCE GRANTED TO YOU BY THESE TERMS, YOU HAVE NO OWNERSHIP OR PROPERTY INTEREST IN ANY OF OUR SERVICES, INCLUDING WITHOUT LIMITATION ONLINE ACCOUNTS AND ANY COINS OR IN-GAME ITEMS.

You must not copy, distribute, make available to the public or create any derivative work from our Services or any part of them unless we have first agreed in writing. In particular, you must not make or make available any cheat or technological measure designed to control access to our Services or any element of them, including access to Coins or in-game items, whether free of charge or otherwise.

The Games, any services and content within them, and the Company's proprietary assets and all intellectual property rights pertaining to them — including inventions, patents and patent applications, trade marks, trade names, copyrightable materials, graphics, sounds, animations, text, images, designs (including the “look and feel” of the Games), specifications, methods, procedures, information, know-how, algorithms, data, technical data, interactive features, source and object code, files, interfaces and trade secrets, whether or not registered or capable of registration — are owned by and/or licensed to the Company and are protected by applicable copyright and other intellectual property laws and international conventions. Notwithstanding anything to the contrary, the Games are licensed to you, not sold. All rights not expressly granted are reserved.

If you believe your intellectual property rights have been infringed on our Services, contact support@2dlogic.com.

You may, at your discretion, provide 2DLogic with suggestions or comments about the Games (“Feedback”). You represent that you are free to do so and that you will not knowingly provide Feedback that infringes a third party's intellectual property rights. You acknowledge that all rights, including intellectual property rights, in such Feedback belong exclusively to 2DLogic, and that 2DLogic is under no obligation to use it. You further warrant that your Feedback is not subject to any licence terms that would require 2DLogic to comply with additional obligations in respect of any current or future product, technology or service that incorporates it.

10. Links

We may link to third-party websites or services. We make no promises regarding any content, goods or services provided by those third parties and we do not endorse them. We are not responsible for any loss or harm they cause, and any charges you incur with them are your responsibility. When you provide data to such third parties you do so under their privacy policy, not ours.

11. Transferring these terms

We may transfer all or part of our rights or responsibilities under these terms to someone else without your consent, provided the transfer does not significantly disadvantage you. You may not transfer any of the rights we give you under these terms unless we agree in writing.

12. Entire agreement

These terms set out the entire agreement between you and us concerning our Services and replace all earlier agreements and understandings between us.

13. Waiver of our rights

Our failure to exercise or enforce any right under these terms does not waive that right. Any waiver is effective only if made in writing and signed by us.

14. Termination, changes and updates

The Company reserves the right, at its sole discretion, to modify, correct, amend, enhance, improve, make other changes to, or discontinue — temporarily or permanently — the Games or any part of them, to prevent Users from accessing the Games, or to limit, suspend or terminate your account (including where the account has not been used for the period stated in section 3), with or without notice, at any time. Content provided in the Games may be changed, extended or removed at any time without notice.

You may lose your user name and any benefits, Coins or in-game items associated with your use of the Games as a result of account termination or limitation, and 2DLogic has no obligation to compensate you for that. 2DLogic is not liable to you or to any third party for any modification, suspension or discontinuance of the Games, or for any error or malfunction that occurs in connection with such changes.

2DLogic may, but is not obliged to, supply updates, upgrades or new versions of the Games (“Updates”). Updates may be applied automatically, with or without notice, and you consent to this. These terms govern any Update unless it is accompanied by a separate licence agreement, which will prevail. You may need to update third-party software from time to time in order to receive the Games. 2DLogic has no obligation to provide any Update.

15. Complaints and dispute resolution

Most concerns can be resolved quickly by contacting us at support@2dlogic.com.

In the unlikely event that we cannot resolve your concern and you wish to bring legal action against us, these terms are governed by and construed in accordance with the laws of Israel.
